請問關於車禍責任歸屬...

昨天聽同事講的，覺得很難接受...

同事說他有天開車在自家附近(台中市市區內)十字路口被撞，現場無監視器及紅綠燈，有報警處理
(我沒看到現場，據說他開的路比較小條，對方的比較大條)

當時同事車速約40公里，對方約6、70公里
對方衝過來的時候完全沒煞車，直接就撞上來了
同事說他根本來不及閃

好在兩台車都夠堅固，雙方都沒有受傷，只是車都被撞爛了

同事的車修理要10萬，對方是名車號稱花了40幾萬

最後到調解委員會去，把責任全部歸到我同事身上
(據說警方說，對方頂多是"未依規定減速"，路權在對方)

於是同事的保險公司賠對方，同事修車的部份自己賠...

很難接受...有路權的人就可以違規卻不用負責任哦？
